Satterlee Stephens Wins Dismissal of Breach of Contract Action


Satterlee Stephens has won the dismissal of a breach of contract action brought against Thomson Reuters by VITAC Corporation(VITAC), in which VITAC alleged that Thomson Reuters violated the notice requirements associated with the termination of an agreement for transcription services.  Justice Eileen Bransten of the New York Supreme Court Commercial Division agreed with the defendant that VITAC’s claim should be rejected as contrary to the plain language of the agreement at issue, and applied Gen. Oblig. Law § 5-903 to find that VITAC’s failure to provide written notice prior to the agreement’s automatic renewal barred the breach of contract claim.  Thomson Reuters was represented in the matter by Satterlee Stephens Partners James Rittinger and Jennifer Philbrick McArdle.
