Satterlee Stephens obtained dismissal of age discrimination claims brought against J.P. Morgan Chase Bank N.A. after successfully urging the Court to strike the plaintiff’s untimely-filed amended complaint and to dismiss the suit prior to discovery. The Court agreed that the plaintiff’s federal claims failed to state a claim for which relief could be granted, because the plaintiff’s complaint stated “at best a mixed motive for [plaintiff’s] termination” and the plaintiff’s argument for equitable tolling of the timeliness requirements in the Age Discrimination in Employment Act lacked merit.
