Satterlee Stephens Defeats Claims Under Computer Fraud and Abuse Act, Stored Communications Act, and Deceptive Trade Practices Law

On behalf of noted architectural/design firm FXFOWLE, Satterlee Stephens obtained the pre-discovery dismissal of the plaintiff’s claims under the Computer Fraud and Abuse Act, Stored Communications Act, and New York’s Deceptive Trade Practices Law.  The plaintiff asserted that the sharing of a single password to an online version of the defendant’s own library materials, hosted by the plaintiff, sufficed to allow the plaintiff to bring statutory claims that provided for remedies including attorneys’ fees and exemplary damages.  The court dismissed those claims, accepting Satterlee’s argument that the defendant’s actions did not qualify as violations of federal and state statutes directed to the prevention of illegal hacking.  FXFOWLE is represented by Satterlee partners Mario Aieta and James Coster
